Welcome to GenerateMD (https://generatemd.com), a SaaS platform offering health system management solutions including AI-powered diagnostic tools, patient management systems, hospital management software, and more (collectively, “Products” or “Services”).

By accessing or using our website and services, you agree to be bound by the following Terms and Conditions (“Terms”). If you do not agree with any part of these Terms, please do not use our services.

1. Definitions

“Company,” “we,” “us,” or “our” refers to GenerateMD.

“You,” “user,” or “client” refers to the individual or entity using our services.

“Services” refers to all software products, tools, APIs, support, and related content provided by GenerateMD.

2. Eligibility

You must be at least 18 years old and capable of entering into a legally binding agreement. Use of the Services is void where prohibited by law.

3. Account Registration

To access certain features, you may be required to create an account. You are responsible for maintaining the confidentiality of your credentials and all activity under your account.

4. License and Use

Subject to these Terms and your subscription plan:

• We grant you a limited, non-exclusive, non-transferable license to use our Services for your internal business purposes.
• You shall not reverse-engineer, copy, modify, or create derivative works.
• You shall not resell or sublicense the Services to third parties.
• You shall not use the Services to store or transmit unlawful or infringing data.

5. Subscription and Payment

Prices for services are listed at https://generatemd.com/product and are subject to change. Subscription plans are billed in advance on a monthly or annual basis. All payments are non-refundable unless otherwise specified in writing.

6. Data Privacy and Security

You retain ownership of all personal health data input into the platform. We implement reasonable administrative, physical, and technical safeguards. Our data practices comply with relevant laws such as India’s Digital Personal Data Protection Act or HIPAA (if operating in the US).

7. Intellectual Property

All software, trademarks, logos, and content on the site are the property of GenerateMD or its licensors. You may not use them without prior written consent.

8. Service Availability and Downtime

We aim to maintain 99.9% uptime, but we do not guarantee uninterrupted access. Scheduled maintenance and unforeseen issues may cause temporary outages.

9. Limitation of Liability

To the maximum extent permitted by law:

• GenerateMD shall not be liable for any indirect, incidental, or consequential damages.
• Our total liability for any claims arising from these Terms or Services is limited to the amount you paid in the past 6 months.

10. Termination

We may suspend or terminate your account if you breach these Terms, if required by law or upon your written request. Upon termination, your access to the platform and data may be removed permanently.

11. Third-Party Services

Our platform may integrate with third-party services. We are not responsible for their content, privacy practices, or functionality.

12. Changes to Terms

We may update these Terms from time to time. We will notify you by email or through the platform. Continued use after changes implies acceptance.

13. Governing Law

These Terms are governed by the laws of India/U.S. Any disputes shall be subject to the exclusive jurisdiction of the courts located in India/U.S.
